Risk response analysis for construction dispute resolution on litigation

Abstract

The complexity of a project is nevertheless will affect the level of its risk; the more complex the project, the more possibility of conflict and dispute in the project to arise. During the project implementation period, disputes between service providers and service users are always and likely to occur, thus cannot be prevented. In resolving the disputes, litigation is preferable with regard to issues of legal content and requires legal and statutory evidence. However, the identification of types, causes, and frequencies that led to litigation or trial processes is time consuming and demands a high cost. This research intended to identify the risks in the litigation process and its impact to the time and cost. The research will also propose the plan for corrective and preventive actions against the risks in order to improve the court performance. The findings of this research analyzed qualitatively, hence to formulate the main factors of the risks. It then develops risk responses by framing and taking preventive and corrective actions.
